Buying property in Antalya or Kemer as a foreigner: legal steps and choosing a lawyer

Antalya province, including coastal towns such as Kemer, Alanya and Side, draws a large share of the foreigners who buy homes in Türkiye. The legal process is well established, but it has features that surprise buyers from other systems: ownership passes only on registration at the land registry, certain zones are closed to foreigners, and the citizenship and residence routes linked to property carry their own conditions. This guide sets out the official framework and how to choose a lawyer to handle it.

This article is general information, not legal advice. Rules and thresholds change; confirm current requirements with official sources and a lawyer registered with a Turkish bar association.

The legal basis for foreign ownership

Foreign individuals buy property in Türkiye under Article 35 of Law No. 2644 on Land Registry. Article 36 deals with Turkish companies that have foreign capital (Invest in Türkiye, Presidency of the Republic of Türkiye Investment Office). The main limits for foreign natural persons are:

  • property can be acquired only in areas where private property is allowed;
  • a foreign individual may acquire up to 30 hectares across the country, unless a larger area is authorised under the law;
  • total acquisitions by foreign individuals may not exceed ten percent of the district area where private property is allowed;
  • foreigners may not acquire or lease property in prohibited military zones or military security zones, and acquisitions in special security zones need the governor's permission;
  • if undeveloped land is bought, a project must be submitted to the relevant administration within two years.

The nationalities that may acquire property, and any special conditions, are determined by the state (Law No. 2644, Art. 35; Invest in Türkiye). A lawyer should confirm at the outset that the buyer's nationality and the specific parcel are both eligible.

Only registration transfers ownership

Many buyers sign a sales agreement with a developer or seller and assume they now own the property. In Türkiye, a preliminary contract does not transfer ownership; only registration at the land registry directorate does (Invest in Türkiye). The official record is the title deed, commonly called the tapu, issued through the General Directorate of Land Registry and Cadastre (TKGM).

This matters most for off-plan purchases. Until the title is registered in the buyer's name, the buyer holds a contractual claim, not ownership. The contract's payment schedule, completion date, penalty terms and security for deposits are where a lawyer adds the most value.

Steps to buy property in Antalya: a step framework

  1. Check the parcel. The TKGM parcel query service lets anyone look up a parcel and its basic details. A lawyer should then examine the land registry record for mortgages, liens, annotations and other restrictions before any money is paid (Invest in Türkiye).
  2. Confirm zoning and permits. For a building, check the building permit and the occupancy permit status with the municipality, and that the unit matches what is registered.
  3. Confirm eligibility. Confirm that the parcel is not in a prohibited military or security zone and that the buyer's nationality may acquire property.
  4. Review the contract. Have the sales or reservation agreement reviewed in a language you understand, with a sworn translation where needed.
  5. Gather documents. The official guidance lists the title or parcel reference, passport or photo ID (with notarised translation if not in Latin script), any representation documents, a document from the municipality stating the property's current value, mandatory earthquake insurance for buildings, and photographs of the parties (Invest in Türkiye).
  6. Book the land registry appointment. Applications are made to the land registry directorate, by appointment through TKGM's online booking system or the Alo 181 line (Invest in Türkiye).
  7. Sign at the land registry and register. The seller and buyer, or their attorneys, complete the transfer at the directorate. Ownership passes on registration.
  8. Handle post-registration steps. These include utility transfers, the annual property tax registration with the municipality, and any residence or citizenship application.

Buying through a power of attorney

Many foreign buyers complete the transfer without travelling, using a power of attorney in favour of a Turkish lawyer. Official guidance says a power of attorney issued abroad must cover the specific procedure, include a photograph, and be apostilled (in Hague Apostille Convention states) or consularly certified, with a notarised Turkish translation (Invest in Türkiye). Because a broad power of attorney gives the holder substantial authority, buyers should limit its scope to the transaction and should hire only a lawyer whose bar registration they have checked.

Residence permits and citizenship linked to property

No residence permit is needed to buy property. Foreigners who own real estate in Türkiye may apply for a short-term residence permit under the Law on Foreigners and International Protection (Law No. 6458), submitting the title deed as evidence (Invest in Türkiye; Presidency of Migration Management). The migration authority applies its own criteria, which have changed over time and can depend on the location and value of the property. Check the current conditions on the Presidency of Migration Management website before relying on this route.

Turkish citizenship by investment is a separate route. A foreigner who buys property worth at least USD 400,000, has the title deed annotated accordingly and undertakes not to sell for three years may apply through the exceptional procedure in Law No. 5901 (Invest in Türkiye). The President makes the final decision. Buyers aiming for citizenship should plan the valuation, payment route and annotations with their lawyer before signing, because they are hard to correct afterwards.

Choosing a property lawyer in Antalya or Kemer

To practise as an attorney in Türkiye, a lawyer must be registered with a bar association under the Attorneyship Law No. 1136; the provincial bars together form the Union of Turkish Bar Associations (Union of Turkish Bar Associations). In Antalya province, that usually means the Antalya Bar Association. A foreign lawyer is not entitled to appear before Turkish authorities as a Turkish attorney.

Points worth checking:

  • Bar registration: ask for the lawyer's bar and registration number and confirm it with the bar association.
  • Independence: the buyer's lawyer should act only for the buyer, not for the developer or the estate agent who introduced the sale.
  • Language: the lawyer should explain documents in a language you understand and use a sworn translator where required.
  • Scope and fees: agree in writing what is covered, such as title checks, contract review, the land registry transfer, and residence or citizenship filings, and how fees are charged.
  • Client money: agree how deposits and the purchase price will be paid and traced. Paying through banks with a clear record protects both sides.

Global Law Lists, an international legal network, features law firms across the region on its Antalya province law firms page and its real estate law firms page. Global Law Lists operates these pages, and listed firms may hold paid memberships; how listings are checked and ordered is explained in the verification methodology. Buyers seeking residence advice can also review immigration law firms.

Common pitfalls for foreign buyers

  • Paying large deposits before the land registry record has been checked.
  • Assuming a reservation or sales agreement makes the buyer the owner.
  • Relying on the seller's or agent's lawyer instead of an independent one.
  • Granting an unlimited power of attorney.
  • Assuming that buying any property guarantees a residence permit or citizenship.

Frequently asked questions

Can foreigners buy property in Kemer or Antalya?

Yes, in areas where private property is allowed and outside prohibited military and military security zones, subject to the 30-hectare and ten-percent district limits under Article 35 of Law No. 2644, and to nationality eligibility.

Do I need a lawyer to buy property in Türkiye?

The law does not require one, but an independent lawyer registered with a Turkish bar association is the usual way for a foreign buyer to check the title, review the contract and, if needed, act under a power of attorney.

How do I find a law firm in Kemer?

Kemer is in Antalya province, and lawyers practising there are typically registered with the Antalya Bar Association. Check registration directly with the bar and confirm the lawyer acts only for you.

Does buying property give me Turkish citizenship?

Only through the investment route: property worth at least USD 400,000 with a three-year no-sale undertaking annotated on the title, and approval by the President.

When do I become the legal owner?

When the transfer is registered at the land registry directorate. A preliminary sales contract alone does not transfer ownership.
